Terms of Service

Welcome to NameEasy. These Terms of Use (“Terms”) govern your access to and use of the NameEasy website and services (the “Platform”). Please read these Terms carefully before using the Platform. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About the Platform

NameEasy is an online platform that provides a searchable database of Indian baby names with detailed cultural metadata including meanings, Rashi (moon sign) associations, deity associations, etymologies, and native scripts. The Platform is designed to help Indian parents and families find and shortlist baby names.

2. Eligibility

The Platform is intended for use by individuals who are 18 years of age or older. By creating an account or using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

3. Account Registration

3.1 Account Creation

You may browse the Platform and use basic features without creating an account. To access certain features (such as saving more than 3 names to your shortlist), you must create an account using one of the following methods:

  • Phone OTP verification (using your Indian mobile number)
  • Google OAuth sign-in

3.2 Account Responsibilities

You are responsible for:

  • Providing accurate and current information during registration.
  • Maintaining the security of your account credentials and devices.
  • All activity that occurs under your account.
  • Notifying us immediately if you suspect unauthorized access to your account.

3.3 Account Limits

The following usage limits apply:

  • Anonymous users (without an account): Up to 3 names may be saved to a shortlist via browser localStorage. These saves are stored locally on your device and may be lost if you clear your browser data.
  • Registered users (free tier): Up to 20 names may be saved to your shortlist. This limit is enforced at the application level.

4. Acceptable Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You shall not:

  • Use the Platform for any illegal or unauthorized purpose.
  • Attempt to gain unauthorized access to any part of the Platform, its servers, or databases.
  • Scrape, crawl, or use automated tools to extract data from the Platform beyond normal search engine indexing.
  • Interfere with or disrupt the Platform's functionality, servers, or networks.
  • Transmit viruses, malware, or other harmful code.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Use the Platform to harass, abuse, or harm others.
  • Reproduce, distribute, or commercially exploit the Platform's name database or content without prior written permission.

5. Intellectual Property

5.1 Our Content

All content on the Platform, including but not limited to the name database, meanings, etymologies, Rashi mappings, deity associations, website design, graphics, user interface, and software code, is the property of NameEasy or its licensors and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our content or services without our prior written consent.

5.2 User Content

By creating a shortlist or interacting with the Platform, you do not acquire any intellectual property rights in the name data or Platform content. Your shortlist is a personal collection referencing our database entries.

6. Name Information Disclaimer

Important: The name information provided on the Platform, including meanings, Rashi associations, deity associations, numerology values, and etymologies, is compiled from various sources and is provided for informational and reference purposes only. While we strive for accuracy:

  • Name meanings and cultural associations may vary by region, community, and family tradition.
  • Rashi and Nakshatra associations are based on traditional Vedic astrology and may differ between astrological systems or practitioners.
  • Numerology values are calculated using the Pythagorean system and are provided for informational interest only.
  • Some names may be marked as unverified, indicating they have not yet been editorially reviewed.

We strongly recommend that you verify name meanings, Rashi associations, and cultural significance with your family pandit, elders, or other trusted cultural advisors before making a final naming decision.

7. Availability and Modifications

We reserve the right to:

  • Modify, suspend, or discontinue any part of the Platform at any time, with or without notice.
  • Update these Terms from time to time. We will post the revised Terms on the Platform with a new effective date.
  • Change the features, functionality, or limits of the free tier at our discretion.

Your continued use of the Platform after any modifications constitutes your acceptance of the updated Terms.

8. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Platform, you consent to the practices described in the Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.

9. Third-Party Services and Advertising

The Platform uses third-party services for its operation, including:

  • Supabase for database hosting and authentication.
  • Twilio for SMS OTP delivery.
  • Google for OAuth authentication.
  • Vercel for website hosting.
  • Mixpanel and Google Analytics for analytics.

The Platform may also display advertisements served by third-party advertising networks. We may work with third parties such as network advertisers to serve advertisements on the Platform and on third-party websites or other media (for example, social networking platforms). These advertising partners may use cookies, pixels, web beacons, and similar tracking technologies to collect information about your browsing activity on the Platform and across other websites and apps in order to deliver targeted advertisements. Your interactions with these third-party services and advertising networks are subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party service providers or advertising networks.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Warranties that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
  • Warranties regarding the accuracy, completeness, or reliability of any name data, meanings, Rashi associations, or other content on the Platform.

11. Limitation of Liability

To the maximum extent permitted by applicable law, NameEasy and its founders, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any and all claims arising out of or relating to your use of the Platform, whether based in contract, tort, strict liability, or any other legal theory, shall be zero. You agree that you use the Platform entirely at your own risk and that we shall have no financial liability to you under any circumstances.

12. Indemnification

You agree to indemnify, defend, and hold harmless NameEasy and its founders, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the Platform.
  • Your violation of these Terms.
  • Your violation of any applicable law or regulation.
  • Any content or information you provide through the Platform.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts in Vadodara, Gujarat, India.

Before initiating any legal proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation for a period of at least 30 days.

14. Termination

We may suspend or terminate your account and access to the Platform at any time, with or without cause and with or without notice, if we believe you have violated these Terms or engaged in conduct that is harmful to the Platform or other users.

You may terminate your account at any time by contacting us at the email address provided below. Upon termination, your shortlist data will be deleted in accordance with our Privacy Policy.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and NameEasy regarding your use of the Platform and supersede any prior agreements or understandings.
